Article: Appealing against a Berneslai Homes decision

I am not happy about a decision Berneslai Homes have made about my housing application.  How can I appeal?

You have the right to appeal against any decision about your application. For example:

  • If we have refused your application, or 
  • The priority we have given you. 

You must register your appeal within 6 weeks of us making and telling you our decision. 

You can appeal in a number of ways:

We will confirm that we have received your appeal within 5 days of us receiving it. We will make a decision about your appeal and tell you in writing within 20 working days. If you are unhappy with this reply you can appeal again in exactly the same way. If you make a second appeal we will arrange for your appeal to be heard by a panel made up of Berneslai Homes' Board Members and a representative from the Federation of Tenants and Residents.  You will be invited to attend the stage 2 appeal hearing and given the opportunity to present your case.

Berneslai Homes Customer Services Team will arrange a date and will contact you to tell you when and where the appeal will be heard. You can attend the hearing and put your case forward in person.

The panel will make a decision and will tell you the outcome of the hearing. If you are not able to attend the hearing they will send you their decision in a letter.

We aim to arrange panel hearings within 6 weeks of your request.

How can I help you with my appeal?

If you want to appeal against any decision we have made about your application please tell us.  When you appeal we need to know:

  • your name,
  • your address,
  • your application reference number;
  • the reason(s) why you disagree with our decision; and
  • any other information you wish to take into account when looking at you appeal. 

How long does it take before I will hear about my appeal?

We will acknowledge receipt of the appeal within 24 hours.  We aim to respond to your initial appeal within 20 working days.  Sometimes complicated appeals can take longer than 20 working days to resolve.  Where this is the case we will write and let you know about the delay.  If we have to arrange an Appeals Panel we will aim to do this within 6 weeks.
