Appealing against a decision we’ve made

This section tells you:

  • what you can appeal against;
  • how to appeal against a decision we have made about your housing application; and
  • what happens when you appeal.
What can I appeal against?

You have the right to appeal against any decision about your application. The following are examples of when you can appeal.

  • You do not agree that we have refused your application to join the waiting list.
  • You do not agree with the priority we have given you.
  • You do not agree when we have taken priority off you.
  • You do not agree that we will not search and apply for vacancies on your behalf.
How can I appeal?

You can ask us to review a decision we have made about your application by completing our Appeal Form.  You must do this within 6 weeks of us making a decision.

When you contact us we will need to know:

  • your name,
  • your address,
  • your housing application reference number;
  • the reason(s) why you disagree with our decision; and
  • any other information you wish to take into account when looking at you appeal.
What happens when I’ve appealed?

We will confirm that we have received your appeal within 5 days of us receiving it. We will make a decision about your appeal and tell you in writing within 20 working days. We call this a Stage 1 appeal.

If you are unhappy with this reply you can appeal again in exactly the same way at what we call stage 2 of the appeals process. If you appeal at stage 2 of the appeal process, we will arrange for your appeal to be heard by a panel made up of Berneslai Homes’ Board Members and a tenant representative. You will be invited to attend the stage 2 appeal hearing and given the opportunity to tell the panel why you felt the decision we made was wrong.  Please note that there is only one stage of appeal against our decision about offering you the help of our search and apply service.  This will be an officer appeal. 

Our Customer Services Team will arrange a date for the stage 2 appeal hearing and will contact you to tell you when and where the appeal will be heard. You can attend the hearing and put your case

The panel will make a decision and will tell you the outcome of the hearing. If you are not able to attend the hearing they will send you their decision in a letter.

We aim to arrange stage 2 appeal hearings within 6 weeks of your request.

How can I help you with my appeal?

If you want to appeal against any decision we have made about your application please tell us. When you appeal we need to know:

  • your housing application reference number;
  • the reason(s) why you disagree with our decision; and
  • any other information you wish to take into account when looking at you appeal.
How long does it take before I will hear about my appeal?

We will acknowledge receipt of the Stage 1 appeal within 5 days of receipt. We aim to respond to your initial appeal within 20 working days. Sometimes complicated appeals can take longer than 20 working days to resolve. Where this is the case we will write and let you know about the delay.

If we have to arrange a Stage 2 Appeals Panel we will aim to do this within 6 weeks.
